Introduction
These Terms of Service govern your use of TrackChronos, operated as a sole trader business based in Australia. By purchasing a licence or using the software, you agree to these terms. If you do not agree, do not use the service.
These terms should be read alongside our Privacy Policy.
The service
TrackChronos is a desktop application that processes GPS telemetry data embedded in GoPro video footage and presents it as lap times, speed traces, and other performance data. The software runs entirely on your local machine. No footage or telemetry data is uploaded to our servers.
Purchase and licence
Access to TrackChronos requires a valid licence key. New customers purchase a one-time licence that covers the current major version of the software (currently v1) and all updates released within that major version. A future major release (for example, v2) will be a separate paid upgrade.
Upon purchase you will receive a licence key by email. This key activates the application and is tied to your email address. It is personal and non-transferable — you may not share, sell, or transfer it to another person.
Refund policy
We offer a 30-day refund on your purchase if you are not satisfied with the software. To request a refund, email contact@trackchronos.com within 30 days of purchase.
Nothing in this policy limits any rights you may have under the Australian Consumer Law.
Licence grant
Subject to a valid licence, we grant you a limited, non-exclusive, non-transferable licence to install and use TrackChronos on your personal computers for your own personal, non-commercial purposes.
You may not reverse engineer, decompile, modify, distribute, sublicense, or create derivative works from the software.
Acceptable use
You agree to use TrackChronos only for lawful purposes and in accordance with these terms. You must not attempt to circumvent the licence validation system, share your licence key, or use the software in any way that could harm us or other users.
Intellectual property
TrackChronos and all associated intellectual property rights remain the exclusive property of the operator. Nothing in these terms transfers any ownership rights to you.
Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of TrackChronos, including but not limited to loss of data, loss of revenue, or damage to equipment.
TrackChronos is provided for informational and performance analysis purposes only. Data accuracy depends on your recording equipment and conditions. Do not rely solely on TrackChronos data for safety-critical decisions.
Termination
We reserve the right to suspend or terminate your access if you breach these terms. Your licence remains valid unless it has been revoked for breach of these terms.
Changes to these terms
We may update these terms from time to time. We will notify you of material changes by email or via the application. Continued use after changes take effect constitutes acceptance of the updated terms.
Governing law
These terms are governed by the laws of Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Australia.
